Legal terms governing your use of the ArtSharing platform
These terms are governed by Swiss law. Exclusive jurisdiction: Tribunal of Lugano, Canton Ticino, Switzerland. Consumer protections under applicable EU directives are preserved where mandatory.
You must be at least 18 years old, legally capable, and pass our KYC/AML verification (via Sumsub) to register. Providing false information constitutes breach of these terms and may result in account termination and notification to competent authorities.
You agree not to: attempt to circumvent platform security measures; use the platform for money laundering, market manipulation, or any activity prohibited under Swiss AMLA, EU AMLD6, or other applicable law; submit documents belonging to others; resell access to your account.
ArtSharing SA uses commercially reasonable efforts to maintain platform availability 24/7 but does not guarantee uninterrupted access. Smart contract state on Polygon remains verifiable on-chain independently of platform availability via Polygonscan.
Primary market purchases are subject to a platform fee disclosed at checkout. Secondary market fees, when applicable, are disclosed in the order book. No hidden fees; no fees without explicit disclosure.
Liability is limited to direct damages and, except in cases of intent or gross negligence, capped at the amount paid by the user to the platform in the 12 months preceding the claim. Nothing in these terms excludes liability for damages that cannot be excluded under Swiss law.
You may close your account at any time. Existing holdings remain yours — they are Partizipationsscheine held in your name and transferable via ERC-1155 token transfer. ArtSharing SA may suspend accounts that breach these terms or applicable regulation.
Before litigation, parties commit to a 30-day good-faith negotiation period. For consumer disputes in the EU, ODR platform access is preserved.
